These Terms of Service ("Terms") govern your use of Optivio Chatbot, operated by Optivio Media ("we", "us", "our"). By creating an account or using the service, you agree to these Terms in full. If you do not agree, do not use the service.

1. Service Description

Optivio Chatbot is an AI-powered chatbot platform designed for ecommerce stores. It allows users to create, configure, and deploy AI chatbots on their websites to answer customer questions, recommend products, and capture leads. The AI responses are powered by OpenAI's GPT models.

2. Account Responsibilities

• You must provide accurate information when creating your account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately if you suspect unauthorised access to your account.
• One account per person or organisation. Sharing accounts is not permitted.

3. Acceptable Use

You agree not to use Optivio Chatbot to:

• Send spam, unsolicited messages, or engage in phishing
• Collect data from website visitors without their knowledge or consent
• Deploy chatbots for illegal, fraudulent, or harmful purposes
• Violate any applicable laws or regulations
• Attempt to reverse-engineer, scrape, or abuse the platform's infrastructure
• Impersonate other individuals or organisations
• Store or transmit malicious code through the platform

We reserve the right to suspend accounts that violate these rules without prior notice.

4. Pricing & Billing

Optivio Chatbot is available on the following plans:

Prices are in USD and subject to change. Existing subscribers will be given notice before any price change takes effect.

5. Payment Processing

All payments are processed securely by Polar.sh. We do not store your credit card details. By purchasing a subscription, you agree to Polar.sh's terms of service. Subscriptions renew automatically each month unless cancelled.

6. Cancellation & Refunds

• You may cancel your subscription at any time from your billing settings.
• Cancellation takes effect at the end of the current billing period — you retain access until then.
• Refunds are handled on a case-by-case basis. Contact info@tahailyas.com if you believe you are entitled to a refund.
• We do not provide prorated refunds for partial months.

7. Service Availability

We aim to provide a reliable, high-uptime service, but we do not guarantee 100% availability. The service may be temporarily unavailable due to maintenance, upgrades, or events outside our control. We are not liable for any losses resulting from service downtime.

8. Data Ownership

• You retain full ownership of your chatbot configuration, training data, and conversation logs.
• You are responsible for ensuring you have the right to use any content you upload or configure.
• We may use aggregated, anonymised data (with no personally identifiable information) to improve the service.
• We will never sell your data to third parties.

9. Intellectual Property

The Optivio Chatbot name, logo, design, code, and all associated intellectual property belong to Optivio Media. You may not copy, reproduce, or use our branding without written permission. Your chatbot content and training data remain your property.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Optivio Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to lost profits, lost data, or business interruption. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months prior to the claim.

11. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in behaviour that is harmful to other users or the platform. We will make reasonable efforts to notify you before termination unless the violation is severe. Upon termination, your access to the service will cease and your data may be deleted.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the website. Continued use of the service after changes take effect constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by applicable international commercial law. For users in the European Union, consumer protection laws of your country of residence may also apply. Any disputes shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration.
